Melbourne Permits & Pool Regulations
Building a pool in Victoria involves several legal requirements. Here's what every Melbourne homeowner needs to know — and how Sienna Pools manages it all for you.
Building Permit Required
A building permit is mandatory for all swimming pools in Victoria under the Building Act 1993 and Building Regulations 2018.
- Application submitted to your local council or a registered private building surveyor
- Structural engineering drawings must accompany the application
- Permit fees vary by council — typically $800–$2,500
- Construction cannot begin until permit is issued
Mandatory Pool Fencing
Victorian law requires compliant pool barriers on all swimming pools under the Building Regulations 2018 — Part 8.
- Minimum 1.2m high non-climbable barrier on all sides
- Gates must be self-closing and self-latching, opening away from pool
- No climbable objects within 900mm of the inside of the fence
- Barriers inspected and certified by a registered building surveyor
Setback & Siting Rules
Pools must comply with siting regulations governing proximity to property boundaries, easements, and existing structures.
- Typically must be set back at least 1m from side and rear boundaries
- Cannot be built over easements or underground services
- Soil conditions and drainage must comply with AS 1926.1
- Siting plans reviewed as part of the permit application process
Water & Safety Standards
All pools must meet Australian Standards for safety and water management to protect both occupants and the environment.
- Compliant with AS 1926.1 and AS 1926.2
- Pool water must not drain to street, stormwater or waterways
- Backwash and drainage must connect to sewer with council approval
- Electrical work must be carried out by a licensed electrician
Pool Safety Inspections
Victoria introduced mandatory pool and spa safety barrier registration from 2020 under amendments to the Building Act 1993.
- All pools must be registered with your local council
- Barriers must be inspected by a registered building inspector
- Inspection required every 4 years following registration
- Certificate of barrier compliance must be lodged with council
